In the wake of a moral reckoning across the nation confronting systemic racism, the U.S. Supreme Court revisited the doctrine of qualified immunity, shielding law enforcement from liability for civil rights violations that don’t violate “clearly established law.”

After the murders of George Floyd in 2020, former Representative Justin Amash (MI-03) and Representative Ayanna Pressley (MA-07) introduced the Ending Qualified Immunity Act in the House of Representatives.
The House passed the George Floyd Justice in Policing Act of 2021 on March 3, 2021. The bill limits the doctrine of qualified immunity in addition to enacting other criminal justice reforms.
In 2020, Senator Edward Markey (D-Mass), Senator Elizabeth Warren (D-Mass) and Senator Bernie Sanders (I-Vt.) introduced the Ending Qualified Immunity Act in the U.S. Senate.
NY State Senator Jackson introduced legislation (S1991) in the State Senate that creates a state remedy for the deprivation of civil rights & seeks to end qualified immunity for law enforcement officials.
The bill is currently co-sponsored by Senator Salazar, Senator Ramos and Senator Rivera.
It was referred to the Senate Committee of Investigations and Government Operations.

The NYC Council passed police reform legislation intended to “reduce the NYPD’s footprint,“ including a measure to limit the defense of qualified immunity for “unreasonable search and seizure and excessive force.”
The bill was returned by Mayor De Blasio to the NYC Council unsigned on April 26, 2021—a symbolic move that indicates disapproval of the provision but does not prevent its enactment.
